This Short-Term Rental Agreement (the “Agreement”) is between Campfire Cabins LLC (“Host”) and the person making the reservation (“Primary Guest”). The “Rental Property” is the accommodation identified in the booking confirmation. Kindling, Ember, and Fireside are located at 9411 Old US 27, Gaylord, Michigan 49735. The Tiny Home is located on a campsite within Hankerd’s Horseshoe Lake Campground, 11344 Old 27 North, Frederic, Michigan 49733, and is not located at 9411 Old US 27.
The Primary Guest must be at least 21 years old, must provide accurate booking information, must stay at the Rental Property for the reservation, and may not transfer or sublet the reservation. The Primary Guest is responsible for ensuring that every occupant and visitor follows this Agreement, posted instructions, House Rules, and—when the Tiny Home is booked—all applicable campground rules.
Electronic acceptance, including selecting an unchecked agreement box and completing the booking, is intended as the Primary Guest’s electronic signature. The booking confirmation, rate details, House Rules, and property-specific safety instructions are incorporated into this Agreement.
Check-in begins at 3:00 p.m. on the arrival date. Checkout is no later than 11:00 a.m. on the departure date unless Host approves different times in writing.

Only registered guests may stay overnight. Visitors may not cause the property’s occupancy or parking capacity to be exceeded and must leave when requested by Host. The Rental Property is for temporary lodging only. Weddings, parties, commercial activity, unlawful conduct, and events are prohibited unless Host gives prior written approval.
The Primary Guest must pay the amounts and by the deadlines shown during booking. Unless the booking page expressly states otherwise, a cancellation received at least 48 hours before the scheduled 3:00 p.m. check-in time qualifies for a refund of amounts paid, less any clearly disclosed nonrefundable payment-processing fee. A cancellation received less than 48 hours before check-in is nonrefundable. No refund or credit is owed for late arrival, early departure, weather, road or trail conditions, insects, wildlife, utility interruptions outside Host’s reasonable control, or dissatisfaction with conditions accurately disclosed before booking.
If Host cannot provide the booked accommodation, Host may offer a comparable substitute or refund the amount paid for the unavailable stay. That refund is the guest’s exclusive contractual remedy unless Michigan law requires otherwise. Host may make reasonable safety repairs or temporarily restrict an amenity; an amenity interruption does not automatically entitle the guest to a full refund.
No security deposit is collected. The Primary Guest authorizes Host to charge the payment card used for the reservation, to the extent permitted by the card issuer and applicable law, for reasonable, documented amounts arising from:
Host will provide an itemized explanation and available supporting documentation. This authorization does not permit arbitrary penalties or charges prohibited by law. The Primary Guest must promptly report damage or an unsafe condition and may not attempt repairs without permission except when immediately necessary to prevent injury or greater property damage.
Open flame, the fire pit, grills, and any approved outdoor cooking equipment involve risks of burns, smoke exposure, fire, and property damage. Use is voluntary and subject to posted instructions, weather conditions, burn restrictions, and governmental orders.
Northern Michigan properties may have snow, ice, mud, roots, uneven ground, falling branches, insects, ticks, wildlife, changing weather, and limited nighttime visibility. Guests must use reasonable care, suitable footwear, lighting, and supervision.
This section applies only to a Fireside reservation. HOT-TUB USE IS VOLUNTARY AND AT THE USER’S OWN RISK. No guest is required or expected to use the hot tub. Each user is responsible for deciding whether use is safe in light of age, health, physical condition, medication, alcohol or drug use, water condition, weather, and surrounding conditions. Hot-tub use carries risks including slipping, falling, burns, overheating, dehydration, infection, illness, unconsciousness, drowning, and serious injury or death.
Host may close the hot tub for cleaning, maintenance, unsafe conditions, or suspected contamination. The guest must stop use and notify Host immediately if water appears abnormal, equipment malfunctions, or a safety concern arises.
The Primary Guest authorizes a $150 hot-tub contamination charge when misuse—including soap, oils, foreign substances, glass, bodily fluids, or other prohibited material—reasonably requires draining, cleaning, sanitizing, and refilling the hot tub. Documented repair costs, damage, and lost rental revenue caused by misuse may be charged separately, but Host will not recover twice for the same loss.
This section applies only to a Tiny Home reservation. The Tiny Home is a separate seasonal accommodation located within Hankerd’s Horseshoe Lake Campground. The Primary Guest must comply with campground quiet hours, parking, visitor, fire, lake, bathhouse, waste, and other rules communicated before or during the stay. Campground amenities, trails, lakes, bathhouse, store, utilities, and recreational facilities may be operated or controlled by third parties and may have separate hours, restrictions, risks, or closures. Pets are prohibited in the Tiny Home.
To the fullest extent permitted by Michigan law, each adult guest voluntarily assumes the ordinary and inherent risks of using the Rental Property and its optional amenities, including the hot tub, fire pit, grills, outdoor areas, yard games, campground facilities, trails, and parking areas. These risks include those specifically described in this Agreement and risks that are open, obvious, or inherent in the activity.
To the fullest extent permitted by law, the Primary Guest releases and agrees not to hold Campfire Cabins LLC and its members, managers, employees, and agents liable for claims arising from such assumed risks or from the guest’s or another member of the reservation party’s misuse, violation of instructions, or negligent conduct. This Agreement does not release liability that cannot lawfully be waived, and it is not intended to excuse Host’s gross negligence, willful misconduct, intentional wrongdoing, or violation of a nonwaivable legal duty.
The Primary Guest agrees to indemnify and hold the released parties harmless from third-party claims, losses, or reasonable expenses caused by the Primary Guest or the reservation party’s breach of this Agreement, unlawful conduct, misuse of the property, or negligent or intentional acts, except to the extent caused by conduct for which Host cannot lawfully disclaim responsibility.
Call 911 for an emergency, then notify Host when safe to do so. For property questions, maintenance, or to report a safety issue, contact Trenton at 989-494-8038. Guests must not tamper with alarms, extinguishers, locks, cameras located in disclosed exterior areas, utility equipment, or hot-tub equipment. Host and its representatives may enter without advance notice when reasonably necessary to address an emergency, suspected property damage, danger, unlawful activity, or a serious rule violation. For nonemergency maintenance, Host will provide reasonable notice when practical.
Host does not guarantee the security of personal belongings, vehicles, ORVs, snowmobiles, or trailers. Guests should lock and secure their property. Items left behind may be discarded, donated, or returned at the guest’s expense after a reasonable holding period.
A material violation—including unauthorized occupancy, a party, violence, unlawful activity, smoking indoors, prohibited pets, dangerous use of fire or the hot tub, or refusal to stop a serious disturbance—may result in immediate termination of occupancy and removal as permitted by law. No refund is owed for unused time when termination results from the guest’s material breach. The Primary Guest remains responsible for authorized charges and damage.
Before the 11:00 a.m. checkout time, the Primary Guest must ensure that:
Michigan law governs this Agreement, without regard to conflict-of-law principles. Any lawsuit relating to the stay must be filed in a court with proper jurisdiction and venue in or serving Otsego County, Michigan, unless applicable law requires otherwise. Before filing a nonemergency claim, the parties will make a good-faith effort for at least 30 days to resolve it informally after written notice.
If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remainder will continue in effect. A failure to enforce a provision once is not a waiver. This Agreement, together with the reservation confirmation, rate terms, House Rules, and incorporated property instructions, is the entire agreement concerning the stay. A conflicting specially negotiated written term signed or expressly confirmed by Host controls over a general term.
By checking the agreement box and completing booking, the Primary Guest confirms that they have read and understand this Agreement, had an opportunity to ask questions, are at least 21 years old, accept financial responsibility for the reservation party, and voluntarily agree to these terms. The guest’s electronic acceptance is recorded with the booking as their signature, together with the reservation number, selected accommodation, dates, and the date and time of acceptance.
